Terms of Service

Last updated: September 22, 2026

Overview

Welcome to DAEDAE.

This website and online store are operated by DAEDAE. Throughout these Terms of Service, the terms “we,” “us,” “our,” and “the Store” refer to DAEDAE.

We operate the Store and its related website and provide information, content, features, tools, products, and services to offer you a shopping experience, collectively referred to as the “Services.” The Store uses Shopify’s ecommerce platform to provide the Services.

These Terms of Service, together with any policies referenced in them, explain your rights and responsibilities when accessing or using the Services.

Please read these Terms of Service carefully. They contain important information about your legal rights, including disclaimers and limitations of liability.

By accessing, browsing, or using the Services, or by purchasing products or services from the Store, you agree to be bound by these Terms of Service and our Privacy Policy. Our Privacy Policy is available at:

https://daedaejewels.com/policies/privacy-policy

If you do not agree to these Terms of Service or our Privacy Policy, you must not access or use the Services.

Nothing in these Terms of Service excludes or limits any consumer right or business liability that cannot lawfully be excluded or limited under applicable law.

Section 1 — Access and Accounts

By accepting these Terms of Service, you confirm that you have reached the legal age of majority in your country or region, or that you have obtained valid consent from a parent or legal guardian.

If you allow a minor to access the Services through a device that you own or control, you are responsible for supervising their use to the extent permitted by applicable law.

When browsing the Store, creating an account, or purchasing products or services, you may be required to provide information such as your email address, billing information, payment information, shipping address, and other necessary details.

You represent and warrant that:

  1. The information you provide to the Store is truthful, accurate, complete, and kept up to date;

  2. You have the right to provide that information; and

  3. You are legally authorized to use the payment method you provide.

You are responsible for maintaining the confidentiality and security of your account information and login credentials and for activity conducted through your account. If you become aware of unauthorized use of your account, please contact us promptly.

You may not sell, transfer, rent, or otherwise permit another person to use your account without our prior written consent.

Section 2 — Our Products and Services

We make reasonable efforts to display descriptions, photographs, colors, sizes, specifications, and other information about our products and services accurately.

However, the product you receive may reasonably differ from its appearance on your screen because of differences in display devices, screen settings, lighting, photography, and production batches.

Unless otherwise required by applicable law, we do not guarantee that product colors or appearances will exactly match their display on an electronic device.

Product descriptions, prices, promotions, and availability may be changed within reasonable limits permitted by law. Changes will not affect orders that we have already accepted or limit any rights granted to consumers by applicable law.

To the extent permitted by applicable law, we may:

  1. Change the content, price, or available quantity of a product or service;

  2. Limit the quantity of a product or service available for purchase;

  3. Limit the availability of products or services to a particular person, geographic region, or jurisdiction; or

  4. Discontinue a product or service.

We do not use statements such as “the Store reserves the final right of interpretation” to exclude or limit rights granted to consumers by law.

Section 3 — Orders

When you place an order, you are making an offer to purchase the relevant products or services from the Store.

An order submission, receipt, or processing notice does not necessarily mean that we have accepted your order. An order is accepted only when we expressly confirm acceptance, approve the payment, or begin fulfilling the order, as indicated by our order confirmation or shipping notice.

To the extent permitted by applicable law, we may refuse, limit, modify, or cancel an order for reasonable grounds, including:

  1. A product is unavailable;

  2. Product information or pricing contains an obvious error;

  3. Payment is declined, unauthorized, or unsuccessful;

  4. We reasonably suspect fraud, unauthorized resale, an export-control violation, or other unlawful activity;

  5. The delivery address is outside our service area; or

  6. A law, regulatory requirement, or circumstance outside our reasonable control prevents us from fulfilling the order.

If we cancel an order after receiving payment, we will refund the applicable amount to the original payment method unless another method is permitted by law or separately agreed with you.

If an order must be changed or canceled, we will attempt to contact you using the email address, telephone number, or billing information provided with the order.

Please review the products, quantities, specifications, shipping address, and contact details before submitting your order. Whether an accepted order can be canceled or modified depends on its processing status, our Refund Policy, and applicable law.

Returns, exchanges, and refunds are governed by our Refund Policy:

https://daedaejewels.com/policies/refund-policy

Unless otherwise stated on the product page, agreed by us in writing, or required by applicable law, products are sold for personal or household use and may not be used for unauthorized commercial resale or unlawful export.

Section 4 — Prices, Taxes, and Billing

The price of a product or service is the price displayed by the Store when you submit the order and listed in the order confirmation, except in the case of an obvious pricing error.

Unless clearly stated otherwise, product prices might not include shipping charges, handling fees, sales taxes, customs duties, import charges, or other legally applicable amounts. Charges collected by the Store will be displayed at checkout where reasonably possible.

International orders might be subject to import duties, sales or use taxes, customs-clearance charges, or other fees. Unless otherwise required by applicable law or stated in our Shipping Policy, these charges might be the recipient’s responsibility.

Prices displayed on the Store website might differ from prices offered through physical stores, third-party platforms, or other sales channels.

We may offer discounts or promotions from time to time. A promotion may be subject to separate terms. If the promotional terms conflict with these Terms of Service, the promotional terms will control for that promotion, but they will not exclude any mandatory consumer rights.

You agree to provide current, complete, and accurate purchase, payment, and account information and to promptly update your email address, payment information, and other necessary details so we can complete transactions and contact you when needed.

You confirm that:

  1. The payment information you provide is truthful, accurate, and complete;

  2. You are legally authorized to use the payment method; and

  3. You will pay the product price, shipping charges, taxes, and other applicable charges disclosed in the order.

Section 5 — Shipping and Delivery

Order-processing, shipping, and delivery times are estimates unless we expressly promise a guaranteed shipping or delivery date.

Delivery may be delayed by carriers, weather conditions, natural disasters, customs procedures, transportation interruptions, public holidays, labor disputes, public-health events, or other circumstances outside our reasonable control.

When a delay occurs, we will provide updates where reasonably practicable. We are not responsible for delays outside our reasonable control, except where applicable law provides otherwise.

We will make reasonable efforts to ship within the time promised on the product page, order page, or order confirmation.

If we cannot ship within the promised time, or within 30 days after receiving an order when no shipping time was stated, we will notify you of the revised expected shipping date and allow you to either accept the delay or cancel the unshipped order for a prompt full refund.

Where required by applicable law, we will obtain your express consent to delayed shipment. If you do not agree to the delay, or if we cannot obtain legally required consent, we will cancel the unshipped order and refund the applicable payment.

To the extent required by applicable law, the risk of loss or damage passes to you when you or a third party designated by you physically receives the product. An exception may apply when you independently select a carrier that was not offered by us.

For information about processing times, shipping origins, delivery areas, charges, customs duties, and lost or delayed packages, please review our Shipping Policy:

https://daedaejewels.com/policies/shipping-policy

Section 6 — Intellectual Property

The Services and their contents—including trademarks, brand names, text, product descriptions, page designs, photographs, graphics, product reviews, videos, audio, software, code, and the selection and arrangement of such materials—are owned by the Store, our affiliates, or applicable licensors and are protected by applicable copyright, trademark, patent, and other intellectual-property laws.

Subject to these Terms of Service, we grant you a limited, non-exclusive, and non-transferable license to access and use the Services solely for personal and non-commercial purposes.

Without our prior written permission, you may not:

  1. Copy, modify, distribute, sell, or rent content from the Services;

  2. Create derivative works based on the Services;

  3. Publicly display, publicly perform, or republish content from the Services;

  4. Remove or alter copyright, trademark, or other proprietary notices; or

  5. Use content from the Services for an unauthorized commercial purpose.

Except as expressly permitted by these Terms of Service, no patent, trademark, copyright, or other intellectual-property right belonging to the Store, Shopify, or a third party is granted to you.

The DAEDAE name, logos, product names, service names, designs, and slogans might be trademarks belonging to the Store or their respective owners. You may not use them without prior written permission from the applicable rights holder.

The Shopify name, logos, product names, service names, designs, and slogans are trademarks of Shopify or its affiliates. All other names, logos, product names, and service names appearing through the Services belong to their respective owners.

Section 7 — Optional Tools

We may provide access to tools, applications, or features supplied by third parties. Unless expressly stated otherwise, we might not control, monitor, or have the ability to intervene in those third-party tools.

To the extent permitted by applicable law, third-party tools are provided on an “as is” and “as available” basis. We make no additional representations, warranties, or endorsements concerning them.

Before using a third-party tool, you should review and accept the relevant provider’s terms and privacy policy.

We are responsible for harm caused by a third party’s conduct, systems, or services only to the extent required by applicable law.

We may introduce new features, tools, or resources through the Services in the future. Unless expressly stated otherwise, those features, tools, and resources will be considered part of the Services and will be subject to these Terms of Service.

Section 8 — Third-Party Links

The Services may contain websites, content, materials, applications, or links provided or operated by third parties.

Unless expressly stated otherwise, we do not control third-party websites and do not guarantee the accuracy, completeness, security, or continued availability of their content.

Before accessing or transacting through a third-party website, you should review its terms of service, privacy policy, refund policy, and other applicable rules.

When you purchase or use products, services, resources, or content through a third-party website, the transaction may take place directly between you and that third party.

We are responsible for damage or loss caused by a third party’s conduct or services only to the extent required by applicable law. Complaints, claims, or questions concerning third-party products or services should be directed to the relevant third party.

Section 9 — Relationship With Shopify

The Store is powered by Shopify, which enables us to provide the Services to you.

However, purchases and sales made through the Store are transactions directly between you and DAEDAE.

By using the Services, you acknowledge that Shopify is generally not the seller in transactions between you and the Store and is not responsible for the Store’s product descriptions, product quality, order fulfillment, shipping, refunds, or customer service.

To the maximum extent permitted by applicable law, Shopify and its affiliates are not responsible for claims, damage, or liability that the Store is legally required to bear as the seller of products or services.

Nothing in this section excludes or limits a right or liability that cannot lawfully be excluded or limited.

Section 10 — Privacy Policy

Personal information that we collect, use, disclose, or otherwise process through the Services is governed by our Privacy Policy, available at:

https://daedaejewels.com/policies/privacy-policy

Because the Services are hosted by Shopify, Shopify processes certain personal information relating to your access to and use of the Services under its applicable terms to provide, protect, and improve its services.

To process orders, payments, shipping, customer service, analytics, and other necessary business functions, your information may be provided to Shopify, payment processors, shipping providers, application providers, and other necessary partners. Those recipients might be located outside your country or region of residence.

For information about how Shopify processes consumer personal information, please review the Shopify Consumer Privacy Policy:

https://www.shopify.com/legal/privacy/consumers

Our Privacy Policy explains the personal information we collect, how we use and share it, how long we retain it, and the privacy rights that might be available to you.

Section 11 — Feedback and User Submissions

If you submit, upload, publish, send, or otherwise provide suggestions, comments, product reviews, photographs, ideas, plans, or other materials to us, those materials are collectively referred to as “Feedback.”

To the extent permitted by applicable law, you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, publish, translate, distribute, and display the Feedback for reasonable purposes, including operating, presenting, promoting, evaluating, and improving the Services.

This license will be limited where required by applicable law or by a separate written commitment from us.

You represent and warrant that:

  1. You own or have obtained all rights and permissions necessary to submit the Feedback;

  2. You have lawfully disclosed any payment, gift, or other incentive connected with the Feedback;

  3. The Feedback is truthful and not misleading;

  4. The Feedback does not violate another person’s copyright, trademark, privacy, publicity, or other legal rights;

  5. The Feedback does not contain unlawful, defamatory, abusive, threatening, obscene, or malicious content; and

  6. The Feedback does not contain a virus or other malicious program that could affect the operation of the Services.

Unless otherwise required by applicable law, we are not obligated to keep Feedback confidential, pay compensation for it, or respond to it.

To the extent permitted by applicable law, we may review, edit, or remove content that is unlawful, infringing, threatening, defamatory, obscene, or otherwise violates these Terms of Service.

You may not use a false identity, false email address, or other method to mislead us or a third party about the source of Feedback.

Section 12 — Errors, Inaccuracies, and Omissions

Information provided through the Services might occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, inventory, shipping charges, delivery times, or availability.

To the extent permitted by applicable law, we may correct errors, update information, or cancel an order affected by an obvious error.

If we cancel an order after receiving payment, we will refund the applicable amount.

This section does not limit any rights you have under applicable law concerning incorrect prices, deceptive advertising, inaccurate descriptions, or other issues.

Section 13 — Prohibited Uses

You may access and use the Services only for lawful purposes.

You may not directly or indirectly use the Services to:

  1. Engage in an unlawful, fraudulent, or malicious activity;

  2. Violate an applicable international, federal, state, or local law or regulation;

  3. Infringe our intellectual-property rights or the legal rights of another person;

  4. Harass, abuse, insult, harm, defame, threaten, or discriminate against another person;

  5. Distribute false, fraudulent, or seriously misleading information;

  6. Upload, send, or reuse material that violates these Terms of Service;

  7. Send spam, chain messages, or unauthorized advertising or promotional material;

  8. Impersonate another person or organization;

  9. Interfere with or restrict another person’s lawful access to or use of the Services; or

  10. Harm the legitimate interests of the Store, Shopify, users of the Services, or another third party.

Except as expressly permitted by Section 14 or separately authorized by us in writing, you may not:

  1. Upload or transmit a virus, malicious code, or other program that could affect the operation of the Services;

  2. Unlawfully copy, scrape, sell, resell, or exploit any portion of the Services;

  3. Collect or track another person’s personal information without authorization;

  4. Conduct phishing, impersonation, pretexting, or other fraudulent activity;

  5. Use a robot, crawler, automated data-collection tool, or agentic artificial-intelligence system to evade our access controls; or

  6. Interfere with, bypass, or circumvent security measures, authorization features, access restrictions, CAPTCHAs, or robot-exclusion rules.

Ordinary search-engine indexing and access expressly permitted through our technical settings or written authorization are not prohibited, provided that such access complies with applicable law and our technical rules.

If we reasonably believe that you have violated these Terms of Service, we may restrict, suspend, or terminate your account or access to the Services to the extent permitted by applicable law.

Section 14 — Automated Agents

14.1

This section applies if you use, permit, or cause an automated agent to access, use, or interact with the Services.

An “Agent” means software or a service capable of acting autonomously or semi-autonomously on behalf of, or at the direction of, a person or organization, including an agentic artificial-intelligence tool.

14.2

An Agent accessing the Services must clearly identify itself as automated and comply with this section, the Store’s published technical rules, and applicable law.

If we use reasonable technical measures or provide express notice requiring a particular Agent to stop accessing the Services, that Agent must stop accessing or interacting with the Services.

14.3

We may use reasonable technical measures to limit an Agent’s access to, use of, or interaction with the Services, provided those measures comply with applicable law.

14.4

An Agent accessing the Services must:

  1. Identify its status as an Agent in applicable HTTP or HTTPS requests;

  2. Use “Agent/Agent Name” or another format that clearly identifies the Agent in its user-agent string;

  3. Not conceal its automated identity by imitating human behavior or through another method;

  4. Not bypass a CAPTCHA or other measure intended to distinguish humans from automated programs;

  5. Truthfully respond to a reasonable request intended to determine whether a visitor is a human or an automated program;

  6. Not bypass a measure intended to limit, modify, or control how an Agent accesses the Services; and

  7. Not collect personal information, protected content, or other non-public data without authorization.

Section 15 — Suspension and Termination

We may suspend or terminate your account or access to the Services to the extent permitted by applicable law if you materially violate these Terms of Service, engage in fraudulent or unlawful activity, threaten the security of the Services, or if we are required to do so by law.

When reasonably practicable and consistent with security, investigations, and legal obligations, we will explain the reason for the suspension or termination.

Termination of the Services or your account does not affect payment obligations, refund rights, order-fulfillment obligations, or other rights and responsibilities that arose before termination.

Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, Feedback, disclaimers, limitations of liability, indemnification, severability, the entire agreement, governing law, and dispute resolution.

Section 16 — Disclaimer of Warranties

General information provided through the Services is for informational purposes. We make reasonable efforts to keep it accurate and current, but we do not guarantee that all general information will always be complete, accurate, or suitable for your particular circumstances.

Except where expressly promised by us or required by applicable law, the Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we make no warranty beyond what is expressly stated on a product page, in an order confirmation, in these Terms of Service, or in another written policy.

We do not guarantee that the Services will always be continuous, uninterrupted, completely secure, or error-free, although we take reasonable measures to maintain their security and availability.

This section does not exclude any product-quality guarantee, statutory warranty, merchantability requirement, refund right, or other consumer right that cannot lawfully be excluded.

Section 17 — Limitation of Liability

To the maximum extent permitted by applicable law, the Store and our affiliates, partners, directors, officers, employees, agents, contractors, licensors, and service providers, together with Shopify and its affiliates, will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of, or inability to use, the Services, including lost profits, lost revenue, loss of data, or replacement costs.

However, nothing in these Terms of Service excludes or limits:

  1. Liability arising from intentional misconduct, fraud, or gross negligence where it cannot lawfully be limited;

  2. Liability for death or personal injury where it cannot lawfully be limited;

  3. Product liability;

  4. Consumer rights that cannot lawfully be excluded or limited; or

  5. Any other liability that cannot lawfully be excluded or limited.

Where applicable law permits liability to be limited but not completely excluded, our liability will be limited only to the maximum extent permitted by law.

Section 18 — Indemnification

To the extent permitted by applicable law, if a third party brings a claim against the Store because of one of the following acts, you agree to be responsible for the resulting losses, liabilities, and expenses that are reasonable and properly established:

  1. Your material breach of these Terms of Service;

  2. Your intentional or unlawful infringement of a third party’s rights; or

  3. Your fraudulent, malicious, or unauthorized access to or use of the Services.

We will notify you of the claim within a reasonable time and allow you to participate in its handling to the extent permitted by applicable law.

We will not enter into a settlement that imposes a non-monetary obligation on you without your reasonable consent.

This section does not require a consumer to assume liability that the consumer is not legally required to bear and does not limit any defense available under applicable law.

Section 19 — Severability

If any provision of these Terms of Service is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law.

Any unenforceable portion will be treated as severed from these Terms of Service and will not affect the validity or enforceability of the remaining provisions.

If a limited modification would make the relevant provision lawful and enforceable, it will be interpreted and applied as closely as possible to its original lawful purpose.

Section 20 — Waiver and Entire Agreement

Our failure or delay in exercising a right under these Terms of Service does not waive that right.

A waiver concerning one breach does not constitute a waiver concerning a later breach of the same or a different provision.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, and other applicable rules incorporated by reference, form the entire agreement between you and us concerning your use of the Services.

If a product page, order confirmation, or specific promotion makes a more specific promise concerning a particular transaction, that specific promise will apply to that transaction.

This section does not exclude any representation, warranty, or consumer right that is binding under applicable law.

Section 21 — Assignment

You may not transfer your account, rights, or obligations under these Terms of Service to a third party without our prior written consent, except where applicable law provides otherwise.

We may transfer our rights and obligations under these Terms of Service in connection with a business reorganization, merger, acquisition, asset transfer, or operational requirement.

If such a transfer would materially affect your rights, we will notify you in advance to the extent required by applicable law.

A transfer will not reduce any rights already granted to a consumer under applicable law.

Section 22 — Governing Law and Dispute Resolution

These Terms of Service and transactions between you and DAEDAE are governed by applicable federal laws of the United States.

For matters not governed by United States federal law, the laws of the state associated with the billing address you provided when placing the order will apply, without regard to that state’s conflict-of-law rules.

If a dispute arises, you should first contact us at dddaejong@gmail.com. The parties will make reasonable efforts to resolve the dispute through email or another online method within 30 days after receipt of the dispute notice.

If the dispute cannot be resolved through negotiation, either party may bring a claim before a court that has lawful jurisdiction. The parties may also voluntarily agree to use online mediation or another form of alternative dispute resolution.

This section does not require either party to travel personally to a particular country, state, or location to handle a dispute. It also does not limit a consumer’s right under applicable law to seek relief from a court, regulator, state attorney general, payment service provider, or other dispute-resolution organization in the consumer’s state.

Section 23 — Headings

Headings in these Terms of Service are included for convenience only and do not limit or otherwise affect the meaning or interpretation of any provision.

Section 24 — Changes to These Terms of Service

You may review the current version of these Terms of Service on this page at any time.

We may update these Terms of Service because of changes in law, service functionality, business processes, security requirements, or other reasonable grounds.

If a change materially affects your rights or obligations, we will provide notice as required by applicable law through a website notice, email, or another reasonable method and will identify its effective date.

Unless applicable law provides otherwise, a change will not retroactively affect an order that was confirmed before the change took effect.

Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms of Service, except where applicable law requires separate consent.

Section 25 — Contact Information
